1. Acceptance of Terms

By accessing or using any ContentSilk service (“Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. ContentSilk, Inc. (“ContentSilk,” “we,” “us,” or “our”) reserves the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms and that the business agrees to them.

2. Description of Service

ContentSilk provides an AI-powered content generation and publishing platform designed for local service businesses. The Service identifies relevant local news and events, generates SEO-optimized content, and publishes it to your connected website on your behalf. ContentSilk currently serves home service verticals including HVAC, roofing, plumbing, real estate, insurance, and related industries.

3. Account Registration

To access the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Take responsibility for all activity that occurs under your account

You must be at least 18 years old to create an account. We reserve the right to terminate accounts that provide false information or violate these Terms.

4. Subscription and Billing

ContentSilk offers subscription plans billed on a recurring monthly or annual basis. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. All fees are stated in US dollars and are non-refundable except as expressly stated in our 90-day results guarantee.

We reserve the right to change our subscription fees. We will provide at least 30 days notice before any price changes take effect. If you do not agree to a price change, you may cancel your subscription before the change takes effect.

90-Day Results Guarantee: If you do not see measurable organic growth within 90 days of your service start date, you are entitled to a full refund of your most recent monthly fee. To claim a refund, contact us at support@contentsilk.com within 30 days of the 90-day period ending. The guarantee applies to your first 90 days of active service only and requires that your website was properly connected and accessible throughout the period.

5. Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service to publish false, misleading, defamatory, or illegal content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Resell, sublicense, or transfer access to the Service to third parties without our consent
  • Use the Service in any way that could damage, disable, or impair its operation
  • Scrape, crawl, or systematically extract data from the Service
  • Violate any applicable local, state, national, or international law or regulation

6. Content and Intellectual Property

Your content: You retain ownership of your business information and any content you provide to us. By using the Service, you grant ContentSilk a non-exclusive, worldwide, royalty-free license to use, reproduce, and process your content solely to provide and improve the Service.

AI-generated content: ContentSilk generates content on your behalf using AI. You own the content published to your website. You are responsible for reviewing published content and ensuring it is accurate and compliant with applicable laws. ContentSilk does not warrant that AI-generated content is error-free or suitable for any particular purpose.

ContentSilk IP: The ContentSilk platform, software, design, and all related intellectual property are owned by ContentSilk, Inc. and are protected by copyright, trademark, and other laws. You may not use our trademarks or branding without our prior written consent.

7. Third-Party Services

The Service may integrate with third-party platforms such as WordPress, Google Business Profile, and others. Your use of those platforms is governed by their own terms and privacy policies. ContentSilk is not responsible for the availability, accuracy, or practices of third-party services.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. CONTENTSILK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

ContentSilk does not guarantee specific search engine rankings, website traffic levels, or business outcomes. The 90-day results guarantee is limited to measurable organic growth as defined in Section 4 and does not constitute a guarantee of any specific business result.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONTENTSILK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF CONTENTSILK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO CONTENTSILK IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

10. Termination

You may cancel your subscription at any time through your account settings or by contacting our support team. Cancellation takes effect at the end of the current billing period; you will continue to have access to the Service until then.

ContentSilk may suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in fraudulent or illegal activity, or if we are required to do so by law. Upon termination, your right to use the Service ceases immediately. Sections 6, 8, 9, and 11 survive termination.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall first be submitted to informal negotiation. If not resolved within 30 days, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

You agree to resolve disputes with ContentSilk on an individual basis only, and waive any right to participate in a class action, class-wide arbitration, or representative proceeding.

12. Changes to These Terms

We may update these Terms at any time. When we make material changes, we will notify you by email or by posting a prominent notice in the platform at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
